In Case of Crisis AI
Terms of Service
These Terms govern a subscription to In Case of Crisis AI, a connector offered by RockDove Solutions, Inc. They cover the trial, billing, your protocols, how the Service may be used, and the limits of what it does.
Written to be read. Where a section has legal weight it says so in plain words first. The Privacy Policy describes what is collected and how it is handled, and is part of these Terms.
1. This Agreement
These Terms of Service (“Terms”) are an agreement between RockDove Solutions, Inc. (“RockDove,” “we”) and the organization that subscribes to In Case of Crisis AI (“Customer,” “you”). They govern access to and use of In Case of Crisis AI, the connector described in Section 2 (the “Service”).
You accept these Terms by requesting a trial, completing checkout, or using the Service. The person who does so confirms that they are authorized to bind the Customer organization. If you do not have that authority, or you do not agree to these Terms, do not use the Service.
If RockDove and the Customer have signed a separate written agreement covering the Service, that agreement controls where it conflicts with these Terms. The Data Processing Addendum referred to in Section 11 is part of these Terms.
2. The Service
In Case of Crisis AI connects an organization’s approved emergency and crisis protocols to the AI assistant its people already use, through the Model Context Protocol. When an authorized user asks a question, the Service returns the relevant protocol text from the Customer’s library, with the protocol named.
The Service retrieves. It does not generate guidance, make decisions, contact emergency services, or take action on the Customer’s behalf. What comes back is the text in the Customer’s library at the moment of the question.
In Case of Crisis AI is a separate product from the In Case of Crisis mobile and web platform. Protocols held in that platform are governed by its own agreement.
RockDove may improve or change the Service over time. RockDove will not materially reduce the core function described in this Section during a paid subscription term without notice.
3. Accounts, Administrators, and Users
The Customer designates one or more administrators. Administrators control which of the Customer’s people can reach the Service, through the Customer’s own AI platform and identity provider. The Customer is responsible for those access decisions and for keeping them current.
The Customer is responsible for all use of the Service under its account, for the accuracy of the information it provides at registration, and for keeping credentials confidential. Tell us promptly at the contact in Section 21 if you believe an account has been compromised.
The Service is for business use by organizations and their personnel. It is not offered to individuals or to anyone under the age of 18.
4. Trial
RockDove offers a seven-day trial with full function. The trial begins when RockDove confirms that the Customer’s account is set up, not when the request is submitted.
A payment method is collected at the start of the trial. The subscription begins and billing starts automatically when the trial ends, unless the Customer cancels before then. RockDove sends a reminder to the account email three days before the trial ends.
During pre-launch, trial requests are taken and accounts are set up as RockDove opens the Service to new organizations. Submitting a request does not by itself create a subscription or a charge.
The Customer may cancel during the trial through the billing portal or by contacting RockDove. A trial cancellation takes effect immediately and no charge is made.
RockDove may limit trials to one per organization and may decline or end a trial that it reasonably believes is not for evaluation purposes.
5. Subscription, Fees, and Billing
The Service is sold as an annual subscription per organization. The price and organization size band that apply to the Customer are the ones shown at checkout or stated in the Customer’s order, and they form part of these Terms.
Payment is handled by Stripe. Card details are entered on Stripe’s hosted checkout and do not reach RockDove. Prices include payment processing. Prices exclude taxes; where RockDove is required to collect sales or similar taxes, they are added to the invoice.
Subscriptions renew automatically for the same period unless cancelled before the renewal date. RockDove sends a billing notice to the account email at each renewal. RockDove may change prices at renewal with at least thirty days’ notice.
If a payment fails, RockDove will notify the account email and retry. If payment is not received within fourteen days, RockDove may suspend access until the balance is paid.
The organization size band selected at checkout must reflect the Customer’s total number of employees. If the Customer grows into a higher band, RockDove may move the subscription to that band at the next renewal.
At launch the Service is offered to organizations in the United States and billed in US dollars. Organizations elsewhere may request a conversation with RockDove.
6. Cancellation and Refunds
The Customer may cancel at any time through the billing portal, which stops future charges at once, or by contacting RockDove at the contact in Section 21. For a paid subscription, cancellation takes effect at the end of the paid period. The Service remains available until then and no further charge is made. During a trial, cancellation takes effect immediately.
When cancelling, the Customer may tell RockDove why. This is optional. RockDove uses it only to learn and to improve the Service, and does not make a further offer as a condition of cancelling.
Fees are not refundable except where these Terms or applicable law require otherwise. RockDove does not prorate refunds for unused time in a paid period.
If you believe a charge is wrong, contact RockDove first. Most billing questions are resolved within a few business days.
7. Customer Protocols and Content
The Customer’s protocols, incident reports, questions, and other material it provides or its users submit through the Service are the Customer’s content. The Customer owns it. RockDove receives a limited license to host, process, retrieve, and display it as needed to provide the Service and as described in the Privacy Policy, and for no other purpose.
The Customer is responsible for its content: that it has the rights to use it, that it has been reviewed and approved by the Customer for its own sites and people, and that it is kept current. A protocol the Service returns is the Customer’s approved text, and the Customer decides what its approved text says.
Customer content is not used to train artificial intelligence models, by RockDove or by any third party acting for RockDove.
8. The Base Protocol Library
RockDove provides a starting library of workplace emergency protocols written from public United States federal-agency guidance and reviewed by a certified emergency management professional. Each carries its public source.
The library is licensed to the Customer for internal use during the subscription. It is a starting point. The Customer must review each protocol and approve or adapt it for its own locations, hazards, staffing, and legal obligations before relying on it. RockDove does not know the Customer’s sites and does not warrant that a library protocol fits them.
The library and all RockDove-authored material remain RockDove’s property. The Customer may not resell, republish, or distribute the library outside its organization.
9. Emergency Use
In Case of Crisis AI is not an emergency service and does not replace one. In an emergency, call 911 or your local emergency number and follow the direction of emergency responders and your organization’s leadership.
The Service returns text. It depends on the Customer’s AI platform, identity provider, network, and devices, none of which RockDove controls, and any of which may be unavailable during an incident. The Customer is responsible for maintaining other ways for its people to reach its emergency procedures.
RockDove does not review the Customer’s protocols for accuracy, completeness, or legal sufficiency, and does not monitor individual questions or responses as they happen.
10. Third-Party AI Platforms
The Service works inside AI assistants offered by Anthropic, OpenAI, and Microsoft under the Customer’s own subscriptions with those providers. Their terms, availability, pricing, and data handling are theirs, not RockDove’s. The Customer is responsible for having the right to connect the Service to its chosen platform and for configuring that platform’s controls.
An AI assistant may add its own words around the text the Service returns, such as a summary or a suggestion. That surrounding text comes from the assistant and its provider, not from the Service or the Customer’s library. The Service’s response is the protocol text and its citation.
RockDove is not responsible for the conduct, output, or outages of third-party platforms, and a platform’s decision to change or withdraw connector support is outside RockDove’s control.
11. Data Protection and Security
RockDove’s handling of personal information is described in the In Case of Crisis AI Privacy Policy (/privacy.html), which is part of these Terms. For customer protocols, connector requests, responses, and audit records processed on the Customer’s behalf, RockDove acts as a processor under the Customer’s documented instructions and the Data Processing Addendum available on request.
The Service writes a record of each question asked and each protocol returned to the Customer’s audit trail. What those records contain and how long they are kept is described in the Privacy Policy.
RockDove maintains administrative, technical, and physical safeguards appropriate to the Service and maintains an annual SOC 2 Type II report, available to customers through RockDove’s Trust Center. RockDove will notify the Customer of a confirmed security breach affecting Customer content without undue delay, as described in the Privacy Policy.
The Service is not designed to hold Social Security numbers, government identification numbers, payment card numbers, health records, or similar highly sensitive personal information. The Customer agrees not to load such information into its protocols or submit it through the Service, and RockDove has no responsibility for such information if the Customer does.
12. Acceptable Use
The Customer and its users will not: use the Service for any unlawful purpose; use it to harm, harass, or endanger any person; attempt to access another organization’s library or account; probe, scan, or test the Service’s security except under a written agreement with RockDove; interfere with the Service’s operation; copy, modify, reverse engineer, or create derivative works of the Service; resell or offer the Service to third parties; or remove notices or citations from returned protocols.
RockDove may suspend access where it reasonably believes use violates this Section, threatens the security or integrity of the Service, or is required by law, and will restore access when the issue is resolved.
Reports of a suspected security vulnerability should go to the contact in Section 21. Do not include protocol content or credentials in an initial report.
13. Intellectual Property
RockDove and its licensors own the Service, the base protocol library, the software, documentation, design, and all related intellectual property. These Terms grant the Customer a limited, non-exclusive, non-transferable right to use the Service for its internal business purposes during the subscription. No other rights are granted.
If the Customer gives RockDove suggestions or feedback about the Service, RockDove may use them without obligation to the Customer.
RockDove may identify the Customer as a customer by name and logo in customer lists only with the Customer’s written permission.
14. Confidentiality
Each party will protect the other’s non-public information received under these Terms with at least reasonable care, use it only to perform under these Terms, and not disclose it except to people who need it and are bound to keep it confidential. Customer content is the Customer’s confidential information. Non-public information about the Service is RockDove’s.
These obligations do not apply to information that is public through no fault of the receiving party, already known to it, independently developed, or required to be disclosed by law, in which case the receiving party will give notice where legally permitted.
15. Warranties and Disclaimers
RockDove warrants that the Service will perform materially as described in Section 2 during a paid subscription. The Customer’s remedy for a breach of this warranty is for RockDove to correct the problem or, if RockDove cannot, for the Customer to cancel and receive a refund of prepaid fees for the remaining period.
EXCEPT AS STATED IN THIS SECTION, THE SERVICE AND THE BASE PROTOCOL LIBRARY ARE PROVIDED “AS IS.” ROCKDOVE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ROCKDOVE DOES NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME, THAT ANY PROTOCOL IS SUITABLE FOR ANY PARTICULAR SITUATION, OR THAT FOLLOWING A PROTOCOL WILL PRODUCE ANY PARTICULAR OUTCOME.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE TO THE OTHER FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, ROCKDOVE’S TOTAL LIABILITY ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE FEES THE CUSTOMER PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply to a party’s indemnification obligations under Section 17, to a party’s breach of Section 14, or to liability that cannot be limited by law.
17. Indemnification
The Customer will defend and indemnify RockDove against third-party claims arising from the Customer’s content, the Customer’s protocols and the actions taken or not taken in reliance on them, or the Customer’s use of the Service in violation of these Terms or the law.
RockDove will defend and indemnify the Customer against third-party claims that the Service, as provided by RockDove and used under these Terms, infringes that third party’s United States patent, copyright, or trademark. This does not cover Customer content, third-party platforms, or use in combination with items RockDove did not provide. If such a claim is made, RockDove may modify the Service, obtain a license, or, if neither is commercially reasonable, end the subscription and refund prepaid fees for the remaining period.
The indemnified party must promptly notify the other, give reasonable cooperation, and allow the indemnifying party to control the defense and settlement, provided no settlement admits fault on the indemnified party’s behalf without its consent.
18. Term, Suspension, and Termination
These Terms apply from the Customer’s first use of the Service and continue while the Customer has an active trial or subscription.
Either party may terminate for a material breach that is not cured within thirty days of written notice. RockDove may suspend or terminate immediately for non-payment after the period in Section 5, for a violation of Section 12, or where required by law.
When a subscription ends, access to the Service stops. For thirty days after that, the Customer may request an export of its protocols and audit records in a common format. After that period RockDove deletes Customer content according to the retention schedule in the Privacy Policy, except where law requires longer retention.
Sections 7 (as to ownership), 8 (as to RockDove’s property), 13 through 17, 19, 20, and this Section survive termination.
19. Government End Users
If the Customer is a United States federal government entity, the Service and related software and documentation are commercial items provided under these Terms in accordance with FAR 12.211 and 12.212 and, for Department of Defense transactions, DFARS 227.7202. Government users receive only the rights set out in these Terms.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any action arising from these Terms or the Service will be brought in the state or federal courts located in Delaware, and each party consents to their jurisdiction.
Before filing any action, the parties will try in good faith to resolve the dispute through direct discussion for at least thirty days after one party gives the other written notice of it.
Any claim arising from these Terms or the Service must be brought within one year after it accrues, to the extent the law allows.
21. Changes, Notices, and General Terms
RockDove may revise these Terms. A revised version states its own effective date and is posted at incaseofcrisis.ai. RockDove will notify the account email of material changes at least thirty days before they take effect for an existing subscription; such changes apply from the Customer’s next renewal unless the Customer agrees sooner. Continued use after the effective date is acceptance.
Notices to the Customer go to the account email. Notices to RockDove go to the address below. The Customer may not assign these Terms without RockDove’s written consent; RockDove may assign them to an affiliate or a successor in a merger or sale. These Terms, the Privacy Policy, the Data Processing Addendum, and the Customer’s order are the entire agreement between the parties about the Service. If any provision is unenforceable, the rest remains in effect. Neither party is liable for delay or failure caused by events beyond its reasonable control. The Service may not be exported or used in violation of United States export laws or by anyone on a United States government restricted-party list.
